Scope of Application

These General Terms and Conditions of Sale ("GTCS") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("the Client" or "Clients"), wishing to purchase the products offered for sale ("the Products") by the Seller on the website deskmat.studio.

The Products offered for sale on the website are as follows: desk mats, mouse pads, and related desk accessories.

The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or materials of the Products, are presented on the website deskmat.studio, of which the Client is required to take note before placing an order. The choice and purchase of a Product are the sole responsibility of the Client. Product offers are valid within the limits of available stock, as specified when the order is placed.

These GTCS are accessible at any time on the website deskmat.studio and shall prevail over any other document.

The Products presented on the website deskmat.studio are offered for sale worldwide.

For any order to a country other than Canada, the Client is considered the importer of the Product(s) concerned. Import duties, taxes, or customs fees may apply depending on the destination country and are the responsibility of the Client.

Please note: only the English version of these General Terms and Conditions of Sale is legally binding.

Prices

The Products are supplied at the prices in effect as displayed on the website deskmat.studio at the time the order is recorded by the Seller.

Prices may be displayed in Canadian dollars (CAD) or United States dollars (USD), depending on the currency selected by the Client on the website.

No sales tax is charged at checkout at this time.

The prices take into account any discounts granted by the Seller as indicated on the website. These prices are firm and not subject to revision during their period of validity; however, the Seller reserves the right, outside of such validity period, to modify prices at any time.

Prices do not include import duties, customs fees, or similar charges that may apply in the Client's destination country, and any such charges remain the responsibility of the Client.

Shipping is currently offered at no additional charge unless otherwise stated on the website at the time of order.

The amount payable by the Client corresponds to the total purchase amount displayed at checkout.

An invoice may be issued by the Seller and provided to the Client upon delivery of the ordered Products.

Orders

It is the Client's responsibility to select on the website deskmat.studio the Products they wish to order, according to the following process:

The Client selects a Product which is then placed in their shopping cart. The Product may be removed or modified before the Client confirms their order and accepts these General Terms and Conditions of Sale.

The Client will then enter their details or log in to their account and choose the delivery method. After validation of the information, the order will be considered final and will require payment by the Client under the conditions provided.

Product offers are valid as long as they are visible on the website, within the limits of available stock.

The sale shall be deemed valid only after full payment of the price.

It is the Client's responsibility to verify the accuracy of the order and to immediately report any errors.

Any order placed on the website constitutes the formation of a distance contract between the Client and the Seller.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is an ongoing dispute concerning payment of a previous order.

The Client may track the status of their order through the website, their account dashboard, or order emails sent by the Seller.

Payment Terms

The price is paid through secure payment under the following terms:
- Payment by credit card
- Payment through approved online payment processors (such as Shopify Payments, Stripe, PayPal, or similar providers)

The price must be paid in full by the Client at the time the order is placed.

Payment data is exchanged in encrypted mode using the protocol defined by the authorized payment service provider handling banking transactions carried out on the website.

Payments made by the Client shall only be considered final once the amounts due have been effectively received by the Seller.

The Seller shall not be required to deliver the Products ordered by the Client if the latter has not paid the full price under the conditions set out above.

Delivery

The Products ordered by the Client will be delivered in Canada or worldwide depending on the delivery options selected.

Deliveries will be made to the address indicated by the Client when placing the order.

Delivery is defined as the transfer to the Client of physical possession or control of the Product.

Except in special cases or in the event of unavailability of one or more Products, the ordered Products will be delivered in a single shipment.

The Seller undertakes to make reasonable efforts to deliver the Products ordered by the Client within the estimated delivery time indicated on the website.

If the Products ordered have not been delivered within thirty (30) days after the estimated delivery date, for any reason other than force majeure or an act attributable to the Client, the Client may cancel the sale by written request.

In such a case, the sums paid by the Client will be refunded within fourteen (14) days following termination of the contract.

Deliveries are carried out by independent carriers to the address indicated by the Client.

The Client must check the condition of the Products upon delivery.

The Client has a period of seven (7) days from delivery to submit claims by email to support@deskmat.studio, accompanied by all supporting documents including photographs.

After this period, and if these formalities have not been complied with, the Products will be deemed compliant and free of any apparent defect.

The Seller will refund or replace, as soon as possible and at its own expense, any Products delivered that are duly proven by the Client to have non-conformities or defects.

The transfer of risk of loss and damage relating to the Products occurs when the Client takes physical possession of the Products.

Transfer of Ownership

The transfer of ownership of the Products from the Seller to the Client shall only take place after full payment of the price by the Client, regardless of the delivery date of said Products.

Return and Refund Policy

Clients may request a return within fourteen (14) days of receiving their order.

The right to return may be exercised by sending an email to the Seller at the email address indicated in Article 1 of these GTCS, clearly expressing the Client's intention to return the product.

The email must include the following information:
- Order number
- Order date
- Client's name
- Client's address
- Reason for return

Returns must be made in their original condition including packaging, accessories, and documentation.

Products that are damaged, soiled, or incomplete may not be eligible for refund.

Return shipping costs are the responsibility of the Client unless the Product is defective or incorrect.

An exchange (subject to availability) or refund will be issued within fourteen (14) days from receipt by the Seller of the returned Products.

Refunds will be issued using the original method of payment whenever possible.

Seller Liability and Warranties

The Products supplied by the Seller benefit from the statutory warranties provided under applicable Canadian consumer protection laws.

The Seller is responsible for Products that are defective, damaged, or not in conformity with the order.

To exercise their rights, the Client must inform the Seller in writing of the non-conformity of the Products as soon as the defect is discovered.

The Seller will refund, replace, or repair Products deemed non-conforming or defective within a reasonable time.

Shipping costs related to defective products may be reimbursed upon presentation of supporting documents.

The Seller's liability shall not be engaged in the following cases:
- Non-compliance with the legislation of the country where the Products are delivered
- Improper use, negligence, or lack of maintenance by the Client
- Normal wear and tear
- Accidents or force majeure

In any event, the Seller's warranty is limited to the replacement or refund of Products that are non-conforming or defective.

Personal Data

The Client is informed that the collection of personal data is necessary for the sale and delivery of Products.

The collection and processing of personal data are carried out in accordance with:
Personal Information Protection and Electronic Documents Act

Personal data collected may include:
- First and last name
- Postal address
- Email address
- Telephone number
- Payment information

Personal data is used solely for the purpose of processing orders, delivering Products, and providing customer service.

The Seller may share necessary information with service providers including:
- Payment processors
- Shipping carriers
- Website hosting providers

Unless explicitly consented to by the Client, personal data will not be used for marketing purposes.

Clients may request access, correction, or deletion of their personal data by contacting the Seller at the email address indicated above.

The Seller implements reasonable technical and organizational measures to protect personal data.

Intellectual Property

The content of the website including designs, graphics, logos, images, and text is the property of the Seller or its partners and is protected by Canadian and international intellectual property laws.

Any reproduction, distribution, modification, or use of this content without prior written authorization is strictly prohibited.

Applicable Law and Language

These General Terms and Conditions of Sale and the transactions arising from them are governed by the laws of Canada and the Province of Ontario.

These GTCS are drafted in English. In the event that they are translated into another language, the English version shall prevail in the event of a dispute.

Disputes

For any claim or complaint, the Client may contact customer service at the Seller's email address indicated in Article 1.

In the event of a dispute, the parties will seek to resolve the matter amicably before initiating legal proceedings.

If no amicable resolution can be reached, disputes arising from these Terms and Conditions shall be submitted to the competent courts of the Province of Ontario, Canada.
